Patent Filing in Thailand

Thailand is a member of the Patent co-operation Treaty and Paris Convention. Patent applications can be filed in Thailand through the PCT route or by filing directly as a conventional application.

  • Substantive Examination
  • First office action
  • Compliance with the Office action either with written statement or hearing
  • Acceptance(notice of allowance) or rejection
  • registration fees
  • Renewal fee is payable from the 5th year
Documents required for filing of Patent Application in Thailand

1. PCT National phase application

  • WIPO Publication
  • International Search Report
  • International Preliminary Examination Report
  • Thai translation of the specification
  • Inventors Declaration
  • Deed of Assignment if applicant different than inventor
  • Power of Attorney

2. Convention Application under Paris Convention

  • Complete specification
  • Set of formal drawings if applicable.
  • Abstract
  • Thai translation of the specification
  • Certified priority document, including priority number and country of origin, should be submitted within 90 days.
  • Thai translated copies of the priority document (s)
  • Power of attorney
  • Deed of Assignment if applicant different than inventor
Remarks:
  • Request for substantive examination can be filed within 5 years from date of publication
  • Notarized Power attorney should be filled within 90 days from date of filing of the application
  • The translation must be submitted within 90 days from date of filing
  • Timeline for entry into National phase in Thailand is 30 months
  • Timeline for filing a conventional application in Thiland is 12 months
