Patent

A patent is a right granted to a person or inventor who has invented something new, useful and unique article or an improvement of an existing article or a new process of making an article. A patent lasts for a limited period which is often referred to as the term of the patent. During the term of the patent the owner of the patent, i.e. the patentee can safeguard his invention and prevent any other person from using the same. After the expiry of the duration of the patent it becomes open to the general public and anybody can make use of the invention. The owner can sell the whole or part of this property. He can grant licenses to others to use or exploit it as it is a form of industrial property or often used as an intellectual property. There is nothing like international or world patent. An application has to be filed by an inventor in each country, where he wants to protect his invention. However, there are International and/or regional treaties to facilitate the procedure to seek protection like PCT and EPC.

How to Patent


A patent is not issued to an invention if it is already exists or granted therefore, the applicant is needed to conduct a patent search before going for registration. After going through the searching process the applicant is needed to apply for the registration. In the registration process the applicant has to file an application in the Patent Office or could be filed through online procedure.
